Does California Have a Separate Capital Gains Tax?

By JC Pacific Corp Published 2026-09-01 Last professionally reviewed: September 2026

California does not provide a separate lower tax rate for capital gains. The California Franchise Tax Board states that California generally taxes capital gains as ordinary income.

Does that mean every home sale is taxable?

No. The seller must first determine whether a taxable gain exists and whether a principal-residence exclusion or another provision applies.

Why might federal and California results differ?

Federal and California tax treatment can differ because of:

  • Different adjustments
  • Residency status
  • Prior depreciation
  • State-specific basis issues
  • California-source income rules
  • Differences in federal and state treatment
  • Carryovers or other return-specific items

Does moving out of California prevent California tax?

Not necessarily. Gain from California real property may remain California-source income even when the seller lives elsewhere at the time of sale.

The California Franchise Tax Board's capital gains and losses page explains how California treats capital gains and why federal and state calculations should be reviewed separately.

Frequently Asked Questions

Does California tax the complete sales price?

Generally, income tax concerns taxable gain, not the entire price.

Is California withholding the tax rate?

No. Withholding is a collection mechanism and does not by itself calculate final liability.

Can a seller estimate state tax using a federal rate?

No. Review the state calculation separately.
