California landlords generally must give reasonable advance written notice before entering an occupied rental for a lawful purpose. Twenty-four hours is generally presumed reasonable for many entries, but the reason, timing, delivery method,and circumstances matter.
When may a landlord enter?
Lawful purposes can include:
- Necessary or agreed repairs
- Inspections
- Providing services
- Showing the property to purchasers, tenants, lenders, workers, or contractors
- Entry under a court order
- Emergency response
- Tenant abandonment or surrender as legally established
Is notice always required?
The claimed purpose should be genuine and connected to the tenancy.
Can a landlord enter whenever convenient?
Notice may not be required during an emergency, when the tenant is presentand consentsat that time, after abandonment or surrender under applicable law, or under other statutory circumstances.
