Can CFIUS Review a Foreign Person's California Real Estate Purchase?
By JC Pacific Corp Published 2026-09-01 Last professionally reviewed: September 2026
CFIUS may have jurisdiction to review certain purchases, leases, or concessions of U.S. real estate by foreign persons when the property is near specified military installations or sensitive government locations or otherwise falls within applicable rules.
Does CFIUS review every foreign home purchase?
No. Coverage depends on location, property rights, buyer status, transaction type, exceptions, and current federal regulations.
Why is California location review important?
California contains numerous military, aerospace, port, technology, and government facilities. A property's ordinary residential appearance does not by itself answer the CFIUS question.
What should buyers do?
Before committing to a potentially covered location:
- Identify the property precisely
- Review current covered-installation lists
- Analyze distance and rights
- Review buyer and ownership structure
- Obtain specialized legal advice
- Consider contract timing and contingencies
