California escrow services may be provided through companies regulated under different laws or exemptions. An independent escrow company and a broker-controlled escrow may not have the same licensing structure.

Independent Escrow

An independent escrow company is generally licensed and regulated under California's Escrow Law by the Department of Financial Protection and Innovation.

The DFPI provides consumer information and license resources ( DFPI escrow consumer information ).

Broker-Controlled Escrow

A California real estate broker may conduct escrow activities in connection with transactions in which the broker is performing licensed real estate activity, subject to applicable exemption conditions and regulation.

Other Providers

Banks, title insurers and other organizations may conduct escrow under different regulatory structures.
