A probate sale is conducted under authority connected to a court-administered estate. A trust sale is generally conducted by an authorized trustee under the trust and applicable law. Either sale can still require legal, title, tax, and disclosure review.

How does authority differ?

In probate, the personal representative's authority comes from court appointment, issued documents, applicable law, and any court limitations. In a trust sale, the trustee's authority generally comes from the trust, successor-trustee provisions, applicable law, and required supporting documents.

Is court approval always required?

Not every probate transaction requires the same level of court involvement, and a typical trust sale may not require confirmation. However, litigation, limited authority, trust terms, beneficiary disputes, or other circumstances can change the process.
